Personal Data Protection Notice

This notice has been prepared by GATAMERK ENDÜSTRİYEL ÜRÜNLER SANAYİ TİCARET LİMİTED ŞİRKETİ in accordance with the Law No. 6698 on the Protection of Personal Data (“Law”) and related legislation. It explains how personal data is processed through contact, quotation and newsletter activities on www.gatamerk.com and during visits to the website. This notice is not a declaration of explicit consent.

2. Personal Data Processed, Purposes and Legal Grounds

Contact form. Full name, company details, email address, phone number, subject and message content. This data is processed to receive, evaluate and respond to your request.

Quotation form. First name, last name, company details, email address, phone number and message content. This data is processed to evaluate your quotation request, prepare the quotation and communicate with you on commercial matters. Equipment and process information shared in requests constitutes personal data to the extent that it identifies a natural person.

Newsletter. Email address and subscription preference. This data is processed to manage your subscription and to send you product updates and technical content. Commercial electronic messages are sent only where the required permission has been obtained, in accordance with applicable legislation. Submitting a contact or quotation request does not by itself constitute marketing consent. You may unsubscribe at any time.

Website security and operation. To keep the website secure and running smoothly, technical data such as IP address, access time, browser and device information and error logs may be processed.

Legal grounds. Your data is processed on the following grounds under Article 5 of the Law:

Processing is directly related to the conclusion or performance of a contract (Art. 5/2-c): quotation and contract processes.
Legitimate interests of the data controller, provided that your fundamental rights and freedoms are not harmed (Art. 5/2-f): responding to requests, corporate communication and website security.
Compliance with a legal obligation (Art. 5/2-ç) and establishment, exercise or protection of a right (Art. 5/2-e): where applicable.
Explicit consent (Art. 5/1): only for non-essential cookies and similar technologies and for consent-based marketing activities, according to the preference you give separately.

3. Method of Collection

Your data is collected, wholly or partly by automated means, through the information you enter in web forms, your newsletter subscription preference, and the electronic communication between your browser and the website infrastructure. This notice does not replace a general notice for employees, job applicants or accounting processes.

4. Recipient Groups to Whom Data Is Transferred

Your data may be transferred, limited to the purposes above and in compliance with Articles 8 and 9 of the Law, to the following groups:

Infrastructure and service providers: Our website is hosted on the Wix infrastructure. Form and website data is processed through this infrastructure.
Analytics and advertising service providers: Our website uses Google Tag Manager, Google Ads tags and Meta Pixel. These technologies operate depending on your cookie preferences. Details are in our Cookie Policy.
Authorized public institutions: Upon request, within the scope of our legal obligations.

Transfers abroad. The systems of service providers such as Wix, Google and Meta may be located abroad. Your data may therefore be transferred abroad. Such transfers are carried out in accordance with the conditions set out in Article 9 of the Law.

5. Retention and Destruction

Your personal data is retained in a manner that is related to, limited to and proportionate with the purpose of processing, for the period required by applicable legislation or by the purpose of processing. When this period ends, your data is deleted, destroyed or anonymized, after considering ongoing legal obligations and the need to establish or protect rights.

6. Your Rights under Article 11 of the Law

By applying to the data controller, you may request to:

Learn whether your personal data is being processed,
Request information if it has been processed,
Learn the purpose of processing and whether data is used in line with that purpose,
Know the third parties to whom your data is transferred, in Türkiye or abroad,
Request correction of incomplete or inaccurate data,
Request deletion or destruction of your data under the conditions set out in Article 7 of the Law, and request that these actions be notified to third parties to whom your data has been transferred,
Object to an outcome against you that arises from the analysis of your data exclusively by automated systems,
Request compensation for damages arising from unlawful processing.

7. How to Apply

You may submit your requests regarding the rights above in accordance with the Communiqué on the Procedures and Principles of Application to the Data Controller, in writing to the address stated above, or by other methods recognized in the Communiqué (including sending to info@gatamerk.com from an email address you previously notified to our company and that is registered in our systems).

Your application should include your identity details, contact details, your request and any relevant documents. Identity verification is carried out proportionately. Applications are concluded as soon as possible according to the nature of the request, and within thirty days at the latest. If the process requires an additional cost, the fee in the tariff determined by the Personal Data Protection Board may be charged.
